Using Warm Lens means agreeing to this. It is written in plain words on purpose: a document nobody can read is not an agreement, it is a formality.
Who runs this site
Warm Lens is run by one person, not a company. The legal name and postal address belong on this page and are not on it yet. They are added here as soon as they exist, and until then this page does not pretend to carry them.
What the site does
You describe a picture and the site makes one. You can also upload a picture and have it restyled, animated into a short clip, sharpened, or have its background removed.
The making is done by a generation service working on our behalf. We send them your description and any picture you uploaded; they send back the result; we store it here for you. The privacy policy has the detail, including the fact that the service is outside Europe.
Your account
One account, one person. You choose the password and you are responsible for what happens under your account, so pick a password you use nowhere else.
You must be at least 16.
We do not check anyone’s age, and there is no way for a site like this to. If we learn that an account belongs to someone younger, we close it.
We can close an account that breaks the content policy or that is being used to attack the site.
Leaving
Every picture and clip on your account has a Delete button, and it removes the file from this site for good. Nothing is removed on a timer: what you keep, you keep, until you delete it.
To close the account itself, write to us. There is no button for it, because closing an account is not a thing to do by accident. When it closes, the files go with it, and so do any credits left on it.
What you may not do
Most of this is obvious. It is written down so that “we can close an account” above has something behind it.
- Do not make what the content policy forbids, or anything that is illegal where you are.
- Do not work round the limits: more accounts to collect the free credits more than once, or scripts that treat the site as a queue to occupy.
- Do not take the site apart. No scraping, no automated requests, no looking for holes. There is no public interface for programs, and the addresses the pages use are not one.
- Do not resell access. What you make is yours; the ability to make it is not yours to sell on.
If you do these, we can close the account, and what was on it goes with it.
Credits
Everything is paid for in credits. What each tool costs is on the pricing page, and that page reads the same numbers the site charges from: it cannot show one price and take another.
A new account gets 20 credits, once. Not once a month, and not once per email address you can think of: once.
A generation that fails returns its credits. If the service refuses the request or never answers, the credits come back automatically. You do not have to ask.
Credits are not money. They are what this site counts work in, and they are only good here: they cannot be transferred to another account, sold on, or turned back into cash on request. What can be refunded, and when, is in the refund policy.
Credits do not expire. There is no clock on them and nothing takes them away for being old.
What you make is yours
We claim no ownership of your results. Use them for whatever you like, including commercially, as far as we are concerned.
The other side of that: the name, the look of these pages, the words on them and the code behind them are ours, and so are the example pictures. Those were made here to show what the tools do. They are not a gallery to take from.
Two honest warnings about that “as far as we are concerned”.
We cannot promise your result is unique. Two people who type similar descriptions can get similar pictures. Nothing here reserves an image for you.
We cannot promise your result is free of anyone else’s rights. These models are trained on very large collections of images, the law about what that means is unsettled and differs from country to country, and a result can resemble an existing work, a trademark or a real person without either of us intending it. If you are going to use a result commercially, that risk is yours to assess, and it is worth taking seriously.
What you upload must be yours to upload
By uploading a picture you are telling us you have the right to. If you do not (someone else’s photograph, a picture of a person who has not agreed) that is on you, not on us. Uploads must be JPEG, PNG or WebP and under 10 MB.
What we do not promise
The site is provided as it is. We do not promise it will be available, that a generation will succeed, that a result will be good, or that it will be suitable for anything in particular.
This is one person running a small site. If something goes wrong, what you can claim from us is limited to what you have paid us in the twelve months before it went wrong. Nothing here limits what the law does not allow us to limit.
We do promise not to be sly about it: if the site is broken we will say so rather than let you spend credits on it.
When the making service is not there
This site does no generating of its own. It asks the service, waits, and collects what comes back. If that service is down, or slow, or refuses a request, nothing is made and the credits for it come back on their own.
That dependency is not a detail we can engineer away. There is no version of this site that works without a service like it.
The site can change, and it can stop
Tools can be added, changed or taken away. What a tool costs can change, and when it does the pricing page changes with it rather than the old number staying up.
The site can also stop. If that happens we will say so here rather than going quiet.
Payment
Payment is by card. Visa and Mastercard are accepted, and the two marks at the bottom of every page say so.
Credits are bought on the pricing page, in the packages shown there or as any whole amount between the smallest and the largest. What you pay and what you get are what that page shows at the moment you buy: it reads the same numbers the site charges from, so it cannot show one price and take another.
If prices change, the pricing page changes with them rather than the old number staying up. A change to these terms is dated at the top.
Changing these terms
The date at the top changes with them. Continuing to use the site after a change means accepting it. A change that materially affects you will be announced on the site rather than slipped in.
Ideas you send us
If you write to us with an idea for the site, we may act on it and we do not owe you anything for it. This is about ideas for the site, not about the pictures you make: those stay yours, as above.
The small print about the small print
If a court decides one part of this does not hold, the rest still does.
These terms, with the privacy policy, the cookie policy, the content policy and the refund policy, are the whole of what is agreed between us. Nothing said anywhere else adds to them.
We can hand the running of this site to somebody else, and if we do, these terms go with it. You cannot hand your account to somebody else.
Law
These terms are governed by the law of the place we operate from, and disputes go to the courts there. If you are a consumer in the European Union, nothing here takes away the rights your own country’s law gives you.
Getting in touch
The contact page has a form, and a person reads what arrives. There is no support desk and no ticket number.
